As Mayor of the City of Vernon, and in the spirit of this gathering, I recognize the City of Vernon is located in the traditional territory of the Syilx People of the Okanagan Nation.

  • THAT Council move to the Committee of the Whole meeting.

  • THAT the meeting be closed to the public in accordance with Section 90 (1) of the Community Charter as follows:

    (a) personal information about an identifiable individual who holds or is being considered for a position as an officer, employee or agent of the municipality or another position appointed by the municipality;

    (d) the security of the property of the municipality;

    (e) the acquisition, disposition or expropriation of land or improvements, if the Council considers that disclosure could reasonably be expected to harm the interests of the municipality;

    (k) negotiations and related discussions respecting the proposed provision of a municipal service that are at their preliminary stages and that, in the view of the Council, could reasonably be expected to harm the interests of the municipality if they were held in public.

  • THAT the Agenda for the August 15, 2022, Regular Open Meeting of Council be adopted as circulated.

  • THAT the minutes of the Regular meeting of Council held July 18, 2022, be adopted;

    AND FURTHER, that the minutes of the Committee of the Whole Meeting of Council held July 18, 2022, be received.

Mayor Cumming will present the following awards from the Government Financial Officers Association:

  • 2022 Distinguished Budget Presentation Award
  • 2022 Certificate of Recognition for Budget Preparation
  • THAT Council receives the letter dated July 19, 2022 from Michele Mark Levine, Director, Technical Services Centre, Government Finance Officers Association regarding receipt of the Distinguished Budget Presentation Award and Certificate of Recognition, for information.

Mayor Cumming will recognize the City of Vernon's Climate Action Plan as being selected by the Planning Institute of B.C. for a Gold award in the category of Excellence in Policy Planning, Small Town & Rural Communities.

Rob Sawatzky will present the report from the Council Remuneration Committee.

    1. THAT Council receive the report titled “Council Remuneration Committee – Recommendations to Mayor and Council, City of Vernon, June 2022”, attached to the report recommendation titled “Council Remuneration” dated August 8, 2022, respectfully submitted by the CAO; 
    2. AND FURTHER, Council endorse the Council Remuneration Committee recommendations as presented; 
    3. AND FURTHER, Council endorse the Council Remuneration Committee recommendation to set the Mayor’s remuneration (base rate) at $2.44 per capita effective November 1, 2021 plus COLA (with the most recent 4 Year rolling average annual BC COLA applied in November), City of Vernon population as determined by the current Statistics Canada, Census Profile, City of Vernon (Census subdivision) total population; 
    4. AND FURTHER, Council endorse the Council Remuneration Committee recommendation to set Councillor remuneration (base rate) at 37% of the current Mayor’s salary, effective November 7, 2022; 
    5. AND FURTHER, that remuneration for Mayor and Councillors be adjusted by the Consumer Price Index for BC, most recent 4 Year rolling average, not seasonally adjusted, August over August, all products in and that such adjustment be made as at November 7 of each year of the 2022-2026 term of Council, commencing November 7, 2022 through to and including November 7, 2025; 
    6. AND FURTHER, Council endorse the Council Remuneration Committee recommendation that Committee meeting pay continue as per present practice of the current Council Remuneration Policy; 
    7. AND FURTHER, Council endorse the Council Remuneration Committee recommendation that the Council benefits package continue as per present practice; 
    8. AND FURTHER, Council authorize an honorarium in the form of a $250 gift certificate for each Council Remuneration Committee member as appreciation for the committee members’ time, thorough review and thoughtful recommendations.  

Supt. Shawna Baher, OIC, RCMP will provide the Second Quarter Report for 2022 (April to June).

  • THAT Council receives for information the RCMP Second Quarter Report for 2022 (April to June), as provided by Supt. Shawna Baher, OIC, RCMP, at the August 15, 2022 Regular Council Meeting.

Gene Bryant, North Okanagan Valley Gleaners, will share with Council the story of the North Okanagan Valley Gleaners and provide an update on their philanthropic activities.

  • THAT Council receive the August 15, 2022 presentation from Gene Bryant of the North Okanagan Valley Gleaners, for information.

  • THAT Council approve Development Variance Permit 00516 (DVP00516) to vary Zoning Bylaw 5000 for Lot 1, DL 73, ODYD, Plan EPP41416 (3202 16th Avenue) as outlined in the report titled “Development Variance Permit Application for 3202 16th Avenue” dated August 2, 2022 and respectfully submitted by the Current Planner, by decreasing;

    1. Section 9.11.6 minimum unit width from 6.5m to 5.5m for proposed Units 1 and 2;

    AND FURTHER, that Council’s approval of DVP00516 is subject to the following;

    1. That the proposed development generally complies with the site plans (Attachment 1) to be attached to and form part of DVP00516;
    2. That the proposed development generally complies with the building elevations (Attachment 2) to be attached to and form part of DVP00516;
    3. That the proposed development generally complies with the landscape plan (Attachment 8) to be attached to and form part of DVP00516; and
    4. That required landscape areas and installations meet Zoning Bylaw 5000 and Landscape Standards Bylaw 5015;

    AND FURTHER, that Council support entering into proposed Housing Agreement Bylaw 5919 (Attachment 7) pursuant to Section 4.9 of Zoning Bylaw 5000 with the owner of Lot 1, DL 73, ODYD, Plan EPP41416 (3202 16th Avenue) prohibiting subdivision under the Land Title Act and the Strata Property Act for a period of 20 years.

  • THAT the Corporate Officer be authorized to issue Development Variance Permit DVP00516 for Lot 1, DL 73, ODYD, Plan EPP41416 (3202 16th Avenue) to vary minimum unit width for the construction of three-plex housing, once all conditions of Council are satisfied.

  • THAT Council support Development Variance Permit Application 00521 (DVP00521) to vary Zoning Bylaw 5000 on LT 1 SEC 10 TWP 13 ODYD PLAN 9430 EXCEPT PLAN 11165 (9353 Eastside Road) as outlined in the report titled “Development Variance Permit Application for 9353 Eastside Road” dated August 3, 2022 and respectfully submitted by the Current Planner, as follows:

    1. Section 4.16.1 to allow construction of a building, structure or swimming pool on slopes 30% or greater; 

    AND FURTHER, that Council’s support of DVP00521 is subject to the following:

    1.  the site plan illustrating the general siting of the proposed single detached dwellings (Attachment 1) be attached to and form part of DVP00521;
    2. development of the property be in accordance with the report titled “Geotechnical Assessment – Proposed Residential Subdivision 9353 Eastside Road, Vernon, B.C.” prepared by Calibre Geotechnical dated February 9, 2021 (Attachment 2), be attached to and form part of DVP00521;
    3. development of the property be in accordance with the report titled “Riparian Area Protection Regulation Assessment” prepared by Canyon Wren Consulting Inc., dated January 21, 2021 (Attachment 3), be attached to and form part of DVP00521; and
    4. if any tree removal is required to develop the property that the applicant obtain a valid Tree Cutting Permit.

  • THAT the Corporate Officer be authorized to issue Development Variance Permit DVP00521 for LT 1 SEC 10 TWP 13 ODYD PLAN 9430 EXCEPT PLAN 11165 (9353 Eastside Road), to vary  Section 4.16.1 of Zoning Bylaw 5000 in order to support a three lot subdivision with construction of three single detached dwellings on slopes greater than 30%, once all conditions of Council are satisfied.

  • THAT Council support Development Variance Permit application 00540 (DVP00540) to vary Zoning Bylaw 5000 on LT 14, DL 56, ODYD, PL 18373 (7333 Tronson Road), as follows:

    1. Section 4.16.1 to allow the construction of buildings, structures and swimming pools on slopes greater than 30%;
    2. Section 6.5.11 to increase the maximum height of a retaining wall from 1.2m to 1.83m;

    AND FURTHER, that Council’s support of DVP00540 is subject to the following:

    1. That the site plan, building elevations and cross-sections, intended to illustrate the siting of structures, drive access and retaining wall height (Attachment 1) in the report titled “Development Variance Permit Application for 7333 Tronson Road” dated August 3, 2022 and respectfully submitted by the Current Planner, be attached to and form part of DVP00540 as Schedule ‘A’;
    2. That a memorandum be provided by Beacon Geotechnical Ltd. confirming the correct civic address of the subject property and the findings of their Geotechnical Investigation Report dated January 5, 2017 (Attachment 5), and that both the memorandum and Geotechnical Investigation Report be attached to and form part of DVP00540 as Schedule ‘B’; and
    3. That issuance of DVP00540 be withheld until a Development Permit for the subject property is authorized to be issued.

  • THAT the Corporate Officer be authorized to issue Development Variance Permit DVP00540 for LT 14, DL 56, ODYD, PL 18373 (7333 Tronson Road), to vary Zoning Bylaw 5000 Section 4.16.1 to permit construction on slopes greater than 30% and Section 6.5.11 to vary the maximum height of a retaining wall from 1.2m to 1.83m, once all conditions of Council are satisfied.

  • THAT Council support Development Variance Permit Application 00544 (DVP00544) to vary Zoning Bylaw 5000 on LT 30, SEC 13, TWP 8, ODYD, PLAN EPP72337 (7163 Apex Drive) as follows:

    1. Section 5.5.5 to increase the maximum net floor area of a secondary suite from 90 m2 to 100 m2;

    AND FURTHER, that Council’s support of DVP00544 is subject to the following:

    1. That the site plan, building elevations and floor plans, intended to illustrate the increased suite size (Attachment 1) in the report titled “Development Variance Permit Application for 7163 Apex Drive” dated August 3, 2022 and respectfully submitted by the Current Planner, be attached to and form part of DVP00544 as Schedule ‘A’.

  • THAT the Corporate Officer be authorized to issue Development Variance Permit DVP00544 for LT 30, SEC 13, TWP 8, ODYD, PLAN EPP72337 (7163 Apex Drive), to vary Section 5.5.5 of Zoning Bylaw 5000 to increase the maximum net floor area of a secondary suite from 90 m2 to 100 m2 , once all conditions of Council are satisfied.

  • THAT Council support Development Variance Permit Application 00552 (DVP00552) to vary Zoning Bylaw 5000 on LT A, DL 72, ODYD, PL KAP57410 (3351 Alexis Park Drive) as follows:

    1. Section 4.16.1 to allow the construction of buildings, structures and swimming pools on slopes greater than 30%;
    2. Section 7.1.2 to decrease the quantity of required parking spaces from 143 stalls to 117 stalls (reduction of 26 stalls);

    AND FURTHER, that Council support Development Variance Permit Application 00552 to vary Subdivision & Development Servicing Bylaw 3843 on LT A, DL 72 ODYD, PL KAP57410 (3351 Alexis Park Drive) as follows:

    1. Section 3.5.7 to permit an access to an arterial road where annual average daily traffic volumes exceed 5000 that is not limited to right in and out movements only without the provision of a designated turn lane.

    AND FURTHER, that Council’s support of DVP00552 is subject to the following:

    1. That the site plan, intended to illustrate the siting of structures, drive access and parking (Attachment 1) in the report titled “Development Variance Permit Application for 3351 Alexis Park Drive” dated August 3, 2022 and respectfully submitted by the Current Planner, be attached to and form part of DVP00552 as Schedule ‘A’;
    2. That a restrictive covenant be registered on title to ensure that the recommendations of the geo-technical report are implemented at the building permit stage, that the areas with slopes greater than 30% that are not required for development remain undisturbed and that the covenant terms provide for future public access through the development to Becker Park and allow establishment of infrastructure required to accommodate a future trail network.

  • THAT the Corporate Officer be authorized to issue Development Variance Permit DVP00552 for LT A, DL 72 ODYD, PL KAP57410 (3351 Alexis Park Drive), to vary Zoning Bylaw 5000 to permit construction on slopes greater than 30% and decrease the number of required parking spaces and Subdivision and Development Servicing Bylaw 3843 to allow all-turn access to Alexis Park Drive, once all conditions of Council are satisfied.

  • THAT Council approve  Development Variance Permit 00558 (DVP00558) to vary Zoning Bylaw 5000 for PCL A (BEING A CONSOLIDATION OF LOTS 7 AND 8 SEE CA9907243) DL 298 ODYD PL EPP44146 (8841 Adventure Bay Road) as outlined in the report titled “Development Variance Permit Application for 8841 Adventure Bay Road” dated August 2, 2022 and respectfully submitted by the Current Planner, by:

    1. Increasing Section 6.5.1.i, the height of a retaining wall, from 1.2m (4.0ft) to 1.5m (5.0ft) along the front and southwest side lot line within the 4.0m front yard setback; and
    2. Increasing Section 6.5.1.ii, the height of a retaining wall, from 2.0m (6.4ft) to 2.5m (8.3ft) along the southwest side lot line behind the front yard setback;

    AND FURTHER, that Council’s approval of DVP00558 is subject to the following:

    1. That the driveway and proposed residential unit(s) be constructed to utilize the existing grade; and
    2. That the retaining wall complies with an updated site plan, elevations, and cross sections to be attached to and form part of DVP00558, with the retaining wall being setback three feet from the side property line.

  • THAT Council support Land Use Contract Discharge 00023 (LUC00023) to discharge Land Use Contract Registration P2461 from the title of LOT 9 SEC 11 TP 13 ODYD PLAN 31060 (9233 Kokanee Road) as outlined in the report titled “Land Use Contract Discharge and Development Variance Permit Applications for 9233 Kokanee Road” dated August 2, 2022 and respectfully submitted by the Current Planner; 

    AND FURTHER, that Council direct Administration to prepare a proposed bylaw and public notice of initial readings to discharge Land Use Contract Registration P2461 from the title of LOT 9 SEC 11 TP 13 ODYD PLAN 31060 (9233 Kokanee Road);

    AND FURTHER, that Council not hold a public hearing on a proposed bylaw to discharge Land Use Contract Registration P2461 from the title of LOT 9 SEC 11 TP 13 ODYD PLAN 31060 (9233 Kokanee Road);

    AND FURTHER, that Council support Development Variance Permit 00577 (DVP00577) to vary Zoning Bylaw 5000 for LOT 9 SEC 11 TP 13 ODYD PLAN 31060 (9233 Kokanee Road) by:

    1. Varying Section 4.16.1, hillside development areas, to allow construction of a single detached house on a slope ≥30%; 
    2. Increasing Section 5.5.5, maximum footprint, from 90m2 to 104.1m2 for a secondary suite located in a secondary building;
    3. Increasing Section 5.5.5, maximum net floor area, from 90m2 to 180.7m2 for a secondary suite located in a secondary building; and
    4. Increasing Section 5.5.6, maximum height, from 6.0m to 6.6m to the mid-point of the sloped roof for a secondary suite located in a secondary building;

    AND FURTHER, that Council’s support of DVP00577 is subject to the following:

    1. That the proposed development generally complies with the site plan (Attachment 1) and secondary suite elevations and floor plans (Attachment 2) to be attached to and form part of DVP00577;
    2. That siting and construction of the single detached house comply with the slope analysis and profiles and geotechnical memo (Attachments 5 and 6) to be attached to and form part of DVP00577; and; 
    3. That a Section 219 Covenant (Wildfire) complying with FireSmart BC guidelines, in favour of the City of Vernon, be registered on the title of LOT 9 SEC 11 TP 13 ODYD PLAN 31060 (9233 Kokanee Road); and
    4. That a Section 219 Covenant, prohibiting the garage from being converted to living space, in favour of the City of Vernon, be registered on the title of LOT 9 SEC 11 TP 13 ODYD PLAN 31060 (9233 Kokanee Road).

*Please note:  DVP00577 will be issued, once all conditions of Council are satisfied, following adoption of “9233 Kokanee Road Land Use Contract LTO Registration Number P2461, Discharge Bylaw Number 5917, 2022”.

  • THAT Council receive the Administration Updates dated August 15, 2022, for information.

  • THAT Council direct Administration to develop bylaw amendments to add short term minor rental as a secondary use in most residential zones in Zoning Bylaw #5000 and create a new Short Term Rental/Bed and Breakfast Minor Business License category to Business Licensing Bylaw #5480 according to the approach and timeline outlined in the memorandum titled “Short Term Rental Regulations Recommendations” dated August 3, 2022 and respectfully submitted by the Long Range Planner;

    AND FURTHER, that Council direct Administration to contract a third party STR compliance monitoring service to create a Short Term Rental/Bed and Breakfast database to support licensing, ongoing monitoring, and enforcement as outlined in the memorandum titled “Short Term Rental Regulations Recommendations” dated August 3, 2022 and respectfully submitted by the Long Range Planner;

    AND FURTHER, that Council approve the expenditure of up to $50,000 from the Development Excess Revenue reserve to hire a third party Short Term Rental compliance monitoring service, as outlined in the memorandum titled “Short Term Rental Regulations Recommendations” dated August 3, 2022 and respectfully submitted by the Long Range Planner.

  • THAT Council receive, for information, the memorandum titled "Public Visual Arts Policy" dated August 8, 2022 and respectfully submitted by the Manager, Long Range Planning and Sustainability.

  • THAT Council receive the report titled "Behind the Mask Mural Project", dated August 8, 2022 and respectfully submitted by the Chief Administrative Officer, and take no further action on the Vernon Public Art Gallery (VPAG) request for support to the project of the same title.

  • THAT Council receive the memorandum titled "Additional Operating Costs Due to Development" dated July 29, 2022, respectfully submitted by the General Manager, Public Works;

    AND FURTHER, that Council authorize Administration to bring forward a service level increase for consideration during 2023 Budget Deliberations for additional operating costs due to development to be funded $105,567 by taxation and $12,871 from Sewer Rates.

  • THAT Council receive the memorandum titled "Aquatics - UV Disinfection System Project", dated August 5, 2022 and respectfully submitted by the Manager, Recreation Facilities;

    AND FURTHER, that Council approve the request to utilize $13,680 in unspent savings from completed 2022 Recreation projects to fund the shortfall in the installation budget for the UV Disinfection System Project;

    AND FURTHER, that Council approve up to $25,000 in unspent savings from completed 2022 Recreation projects to fund an additional contingency should any change orders arise during installation.

  • THAT Council receive for information the memorandum titled "Kal Tire Place North - Sport Flooring Update", dated August 5, 2022 and respectfully submitted by the Manager, Recreation Operations and the Manager, Customer Service Recreation;

    AND FURTHER, that Council authorize Administration to purchase any necessary equipment and accessories required for the efficient storage, maintenance and installation of the Rec-Turf carpet system at a cost of up to $12,000 to be sourced from the Recreation Operational Reserve.

  • THAT Council receive for information the memorandum titled "Child Care Space Creation Projects Progress - August", dated August 5, 2022 and respectfully submitted by the Manager, Community Recreation.

  • THAT Council receive the memorandum titled “Aquatics – Lap Pool Painting”, dated August 9, 2022 and respectfully submitted by the Manager, Recreation Facilities; 

    AND FURTHER, that Council approve the request to reallocate funding from the Aquatics – Fire Suppression Upgrade for $50,750 and Aquatics – Leisure Pool Duct Painting for $15,000 to fund the Lap pool sandblasting and painting;

    AND FURTHER, that Council approve up to $60,000 in unspent savings from completed 2022 Recreation projects to fund the balance of the lap pool sandblasting and painting and have an additional contingency should any challenges arise during the project.

  • THAT Council receive the memorandum titled "Traffic Signal Conflict Monitor Tester" dated August 3, 2022, respectfully submitted by the Manager, Roads, Drainage and Airport;

    AND FURTHER, that Council authorize the expenditure of up to $26,000 for the purchase of a traffic signal conflict monitor tester to be funded from the 2021 Unexpended Uncommitted balance.

  • THAT Council receive the report titled "Snow and Ice Control - Service Level Review" dated August 3, 2022, respectfully submitted by the Manager, Roads, Drainage and Airport for information.

  • THAT Council receive the memorandum titled "Public Works - Excavator Attachments" dated August 3, 2022, respectfully submitted by the Manager, Roads, Drainage and Airport;

    AND FURTHER, that Council authorize the expenditure of up to $60,000 for the purchase of an excavator breaker attachment and excavator tilt bucket attachment to be funded from the 2021 Unexpended Uncommitted balance.

  • THAT Council receive the memorandum titled "Downtown Holiday Decorations - Bulb Replacement" dated August 3, 2022, respectfully submitted by the Manager, Roads, Drainage and Airport, for information.

  • THAT Council receive the memorandum titled “Specialized Enforcement Unit – Patrol Vehicle Purchase” dated August 3, 2022 and respectfully submitted by the Director, Operation Services;

    AND FURTHER, that Council authorize the expenditure of up to $66,000 for the purchase of a specialized enforcement unit patrol vehicle to be funded from the 2021 Unexpended Uncommitted balance. 

  • THAT Council receive the memorandum titled “2023 Fleet Vehicle Replacement – Early Budget Approval” dated July 25, 2022 and respectfully submitted by the Director, Operation Services;

    AND FURTHER, that Council authorize early budget approval for the replacement of fleet units 020,023,028, 054, 057, 316, 501, and 118 at a cost not to exceed $1,310,000, to be funded from Vehicle and Equipment Replacement Reserve.

  • THAT Council receive the memorandum titled "Bylaw Compliance 2023 Budget Priorities" dated July 27, 2022 respectfully submitted by the Manager, Protective Services;

    AND FURTHER, that Council direct Administration to bring forward a Service Level Adjustment for consideration during 2023 budget deliberations for one full time Bylaw Compliance Officer at a fully loaded cost of $92,741, to be funded through taxation.

  • THAT Council direct Administration to develop bylaw regulations for Council's consideration that prohibit the feeding of wildlife within the City of Vernon as outlined in the memorandum titled "Regulations Prohibiting the Feeding of Wildlife", dated July 27, 2022 and respectfully submitted by the Manager, Protective Services.

  • THAT Council receive for information the memorandum titled "2022 Second Quarter Overtime Summary" dated July 22, 2022 and respectfully submitted by the Director, Financial Services.

  • THAT Council receive for information the memorandum titled "June 30, 2022 Variance Analysis" dated July 29, 2022 and respectfully submitted by the Director, Financial Services.

  • THAT Council receive the memorandum titled “Financial Operations Staffing Request”, dated July 28, 2022 and respectfully submitted by the Manager, Financial Operations

    AND FURTHER, that Council authorize $39,173 for the addition of one full-time equivalent in 2022 in the Financial Operations department to be funded from increased Investment Income.

    AND FURTHER, that Council authorize $117,518 in the 2023 budget for the addition of one full-time equivalent in the Financial Operations department to be funded from increased Investment Income with annual cost of living adjustments for future years.

     

  • THAT Council endorse the consent for Greater Vernon Trails and Natural Spaces Bylaw No. 2810, 2022, as follows:

    CONSENT on behalf of City of Vernon

    Pursuant to the provisions of Section 346 [Consent on behalf of municipal participating area] of the Local Government Act, the Council of the City of Vernon does hereby consent, in writing, on behalf of the electors of City of Vernon, to the Board of the Regional District of North Okanagan adopting the following bylaw:

    Greater Vernon Trails and Natural Spaces Service Conversion and Service Establishment Amendment Bylaw No. 2810, 2022

    As described in the memorandum titled “Regional District of North Okanagan Greater Vernon Trails and Natural Spaces Service Conversion Bylaw No. 2810, 2022” dated August 8,2022 and respectfully submitted by the Manager, Long Range Planning and Sustainability;

    AND FURTHER, that Council direct Administration to forward the consent resolution to the Regional District of North Okanagan.

  • THAT Council receive the memorandum titled “Resources for Bargaining” dated July 22, 2022 and respectfully submitted by the Director, Financial Services;

    AND FURTHER that Council authorize the expenditure of up to $40,000 to hire a consultant to assist with IAFF Local 1517 negotiations, to be funded from the 2021 Unexpended Uncommitted Balance.

  • THAT Council support, in principle, the creation of a full time Coordinator, Talent Acquisition and Retention position for a cost of approximately $87,500, to be funded through taxation;

    AND FURTHER, that Council direct Administration to bring forward a Service Level Adjustment for the addition of a Coordinator, Talent Acquisition and Retention, during the 2023 Budget process, as described in the memorandum titled "Talent Acquisition and Retention Staffing Request" dated August 5, 2022, respectfully submitted by the Director, Human Resources.

  • THAT Council amends the Parks and Public Places Bylaw 5057 as outlined in the report titled "Civic Memorial and Kin Athletic Park Inclusion No Overnight Shelter Areas" dates July 26, 2022 and respectfully submitted by the Manager, Long Range Planning and Sustainability.

  • THAT Council direct Administration to prepare a letter of appreciation under the Mayor’s signature to the Superintendent, Trustees and Staff of School District No. 22 for coordinating the May 31, 2022 Youth Climate Action Summit;

    AND FURTHER, that Council direct Administration to explore how School District No. 22 and the City of Vernon can work in collaboration to facilitate future School District No. 22 Youth Climate Action initiatives, as outlined in the memorandum titled “Climate Action Advisory Committee Resolutions: Youth Climate Action Summit” dated August 2, 2022 and respectfully submitted by Laurie Cordell, Manager Long Range Planning and Sustainability.

  • THAT, Council agrees to acquire the Licence for tenure of Hurlburt Park for the term of 30 years from the Province over the land described as all the unsurveyed Crown foreshore being part of the bed of Okanagan Lake and fronting on Eastside Road and that portion of the North ½ of the North East ¼ Shown on plan B3945, Section 4, Township 13, Osoyoos Division Yale District, containing 2.2 hectares, more or less for the community park purposes as outlined in the memorandum titled “Hurlburt Tenure Application – Resolution Requirement” dated August 2, 2022 and respectfully submitted by Laurie Cordell, Manager Long Range Planning and Sustainability.

  • THAT Council confirms its authorization in principle for the addition of 2,600 transit hours per year for the new Local Transit Network Route #10 - Middleton Mountain starting January 2024 at an estimated cost of $194,577 annually, of which the City of Vernon would fund 48.92% ($95,187) of the operating costs;

    AND FURTHER, that Council confirms its authorization in principle for the addition of 560 transit hours per year for additional Statutory Holiday Service starting January 2024 at an estimated cost of $26,186 annually, of which the City of Vernon would fund 89.99% ($23,565) of the operating costs;

    AND FURTHER, that Council approve partial funding of the new Route #10 – Middleton Mountain and additional Statutory Holiday Service from the Transit Expansion Reserve for three years (2024 to 2026) drawing $100,000 +/- in 2024, $60,000 +/- in 2025 and $30,000+/- in 2026; 

    AND FURTHER, that Council authorize Administration to sign the 3 Year Transit Expansion Initiatives Memorandum of Understanding, dated June 30, 2022 from BC Transit, for the addition of 3,160 transit hours, subject to funding approvals from BC Transit and the District of Coldstream effective January 2024, as presented in Attachment 3 of the report titled “3 Year Transit Expansion Initiatives Memorandum of Understanding – New Middleton Route and Additional Statutory Holiday Service” dated August 4, 2022 and respectfully submitted by the Manager, Transportation.

    AND FURTHER, that Council authorize the increase in transit operating expenditures substantially as presented in the report titled “3 Year Transit Expansion Initiatives Memorandum of Understanding – New Middleton Route and Additional Statutory Holiday Service” dated August 4, 2022 and respectfully submitted by the Manager, Transportation.

  • THAT Council agrees to acquire the Licence for the term of 30 years from the Province, for public lake access purposes, over the land described as:

    1. All that unsurveyed Crown foreshore being part of the bed of Okanagan Lake and fronting on Delcliffe Road, Section 4, Township 13, Osoyoos Division Yale District, containing 0.22 hectares, more or less;
    2. All that unsurveyed Crown foreshore being part of the bed of Okanagan Lake and fronting on Whitepoint Road, Section 9, Township 13, Osoyoos Division Yale District, containing 0.30 hectares, more or less;
    3. All that unsurveyed Crown foreshore being part of the bed of Okanagan Lake and fronting on Peters Road, Section 14, Township 13, Osoyoos Division Yale District, containing 0.17 hectares, more or less;
    4. All that unsurveyed Crown foreshore being part of the bed of Okanagan Lake and fronting on Okanagan Landing Road, Section 14, Township 13, Osoyoos Division Yale District, containing 0.12 hectares, more or less;
    5. All that unsurveyed Crown foreshore being part of the bed of Okanagan Lake and fronting on Okanagan Landing Road, Section 14, Township 13, Osoyoos Division Yale District, containing 0.07 hectares, more or less;
    6. All that unsurveyed Crown foreshore being part of the bed of Okanagan Lake and fronting on Kennedy Lane, District Lot 56, Osoyoos Division Yale District, containing 0.07 hectares, more or less;
    7. All that unsurveyed Crown foreshore being part of the bed of Okanagan Lake and fronting on Beachcomber Bay Road, District Lot 296, Osoyoos Division Yale District, containing 0.09 hectares, more or less;
    8. All that unsurveyed Crown foreshore being part of the bed of Okanagan Lake and fronting on Tronson Road, District Lot 296, Osoyoos Division Yale District, containing 0.82 hectares, more or less;
    9. All that unsurveyed Crown foreshore being part of the bed of Okanagan Lake and fronting on Tronson Road, District Lot 298, Osoyoos Division Yale District, containing 0.06 hectares, more or less; and
    10. All that unsurveyed Crown foreshore being part of the bed of Okanagan Lake and fronting on Foster Road, District Lot 298, Osoyoos Division Yale District, containing 0.67 hectares, more or less.
  • THAT Council approve the installation of a mural on the west wall of the building located at 2319 53 Avenue as proposed by Roster Sports Club Bar and Grill in their request dated July 28, 2022; 

    AND FURTHER, that Council approve the proposed mural design as submitted by Roster Sports Club Bar and Grill and included as Attachment 1 in the report titled "The Roster Sports Club Bar and Grill - Mural Request for 2319 53 Avenue" dated August 2, 2022 and respectfully submitted by the Economic Development Planner.

  • THAT Council receives the report dated August 4, 2022, titled "Active Living Centre Referendum Strategic Communications Plan", respectfully submitted by the Manager, Communications and Grants;

    AND FURTHER, that Council endorse the Active Living Centre Referendum Strategic Communications Plan, as presented.

  • THAT Council support, in principle, the creation of a full time Deputy Chief position for a cost of approximately $184,000, to be funded through taxation; 

    AND FURTHER, that Council direct Administration to bring forward a Service Level Adjustment for the addition of a Deputy Chief position, during the 2023 Budget process, as described in the memorandum titled “Request for Full Time Equivalent Deputy Chief Position” dated July 18, 2022, respectfully submitted by the Director of Fire Rescue Service.

  • THAT Council receive the memorandum titled “Additional RCMP Regular Member Increase for 2023 Budget” dated August 9th, 2022 respectfully submitted by the Officer in Charge of Vernon North Okanagan Detachment;

    AND FURTHER, that Council direct Administration to bring forward a Service Level Adjustment for consideration during the 2023 budget deliberations for two Regular Members of the RCMP at a fully loaded cost of $414, 000 to be funded through taxation. ($460, 000 before 10% Federal payment).

  • THAT Jennifer Bruns be appointed Corporate Officer and assigned the powers, duties and functions under section 148 of the Community Charter;

    AND FURTHER, that Jennifer Bruns be appointed a Freedom of Information (FOI) Head for the City of Vernon as required under section 77 of the Freedom of Information and Protection of Privacy Act.
