Mayor Cumming called the meeting to order at 8:43 am.

As Mayor of the City of Vernon, and in the spirit of this gathering, I recognize the City of Vernon is located in the traditional territory of the Syilx People of the Okanagan Nation.

Mayor Cumming reconvened the Regular Open Meeting at 10:13 am and requested a motion to move to In Camera.

    THAT the meeting be closed to the public in accordance with Section 90 (1) of the Community Charter as follows:

    (d) the security of the property of the municipality;

    (i) the receipt of advice that is subject to solicitor-client privilege, including communications necessary for that purpose;

    (k) negotiations and related discussions respecting the proposed provision of a municipal service that are at their preliminary stages and that, in the view of the Council, could reasonably be expected to harm the interests of the municipality if they were held in public;

    THAT the meeting be closed to the public in accordance with Section 90 (2) of the Community Charter as follows: 

    (b) the consideration of information received and held in confidence relating to negotiations between the municipality and a provincial government or the federal government or both, or between a provincial government or the federal government or both and a third party.

    THAT Council waive section 12.(c) of City of Vernon Council Procedure Bylaw Number 4840 which requires that Council not act on a request from a delegation until the next Regular Meeting, unless consent by a two-thirds vote of Council present is given to consider the matter following the delegation's presentation.

    THAT Council receive the memorandum titled “2023 Canada Day Celebration and Activities” dated May 29, 2023, respectfully submitted by the General Manager, Public Works;

    AND FURTHER, that Council endorses the July 1, 2023 Canada Day celebration and activities in Polson Park as presented to Council by the North Okanagan Canada Day Society (NOCDS) at the June 12, 2023 regular meeting of Council;

    AND FURTHER, that Council reconfirms the appointment of Councillor Durning as the Council Liaison to the Canada Day Society, and confirms that as a Council Liaison they shall provide direction and control on all plans and arrangements made by the NOCDS so as to be able to resolve any issues or changes in plans to ensure the City’s interests are safeguarded;

    AND FURTHER, that Council approves the provision of liability insurance through the City’s carrier for the 2023 Canada Day celebration and activities in Polson Park;

    AND FURTHER, that Council directs Administration to ensure liability insurance policies which name both the City and the NOCDS as additional insured are in place in relation to dancing, BC Wildfire display, story walk, carnival games (dunk tank, bouncy castle/slide), water park, chalk art, art projects, skateboarding, Fruitfest, bike parade and shuttle service as well as signed waivers of liability insurance prior to the events proceeding;

    AND FURTHER, that Council directs Administration to issue a business license to the NOCDS at no cost;

    AND FURTHER, that Council approves the in-kind items requested (use of Polson Park, tables and chairs, parks keys, employee site support, porta potties, traffic control, permits, fencing and signage) to the NOCDS for the Canada Day celebration and activities; 

    AND FURTHER, that Council authorize the use of both the $10,000 and the $2,000 2023 budget amounts for the NOCDS to plan and deliver family events for Canada Day 2023.

Annette Sharkey, Executive Director, Social Planning Council of the North Okanagan provided the Social Planning Council / Partners in Action Quarterly Report: January to May, 2023.

The following points were noted:

  • Homeless count conducted April 27, 2023
  • Numbers anticipated to be higher than in 2021
  • Homelessness Crisis Intervention Team has worked with 275 people since October 2022 with 135 active files
  • Complex care units needed
  • Additional funding for affordable housing expected to be announced in fall of 2023
  • Added 437 units of non profit affordable housing, an additional 192 units are in various stages of construction 
  • Overdose deaths are increasing year over year since 2020
  • Folks on Spokes and Ambassador programs are seeing continued success
  • 450 people from 50 different countries have been approved through the Rural and Northern Immigration Pilot Program 
  • Vernon and District Immigrant Services supporting 300 displaced Ukraine citizens
  • Happipad service explained

    THAT Council support Development Variance Permit Application 00587 (DVP00587) to vary Zoning Bylaw 5000 for Lot 1, Sec 2, Twp 8, ODYD, Plan 21198 (3501 11th Street) as outlined in the report titled "Development Variance Permit Application for 3501 11th Street" dated May 31, 2023 and respectfully submitted by the Current Planner, as follows:

    1. Varying Section 9.4.5, minimum rear yard, from 6m to 3.15m for the existing house on proposed Lot 1.

    AND FURTHER, that Council's support of DVP00587 is subject to the following:

    1. That the site plan (Attachment 1) be attached to and form part of DVP00587.

Luc Girouard Cabin

Council inquired regarding the future of Luc Girouard Cabin.  An Admin update will be provided. 

Councillor Durning left the meeting at 2:57 pm

Cooling Requirements in Residential Development

Council inquired regarding cooling requirements in residential buildings and expected changes to the BC building code. Admin. advised of anticipated Building Code changes that will be released in September 2023.

    THAT Council receive for information the memorandum titled "Marshall Field - Proposed Fencing" dated May 10, 2023, and respectfully submitted by the Manager, Parks and Public Spaces;

    AND FURTHER, that Council authorize Administration to install a fence at Marshall Field, as identified in the memorandum titled "Marshall Field - Proposed Fencing" to alleviate the interaction between dogs in the off leash dog park and public spectator areas of the ball field, at a cost not to exceed $45,000 to be funded $10,000 donated from Vernon Minor Baseball and $35,000 from 2022 Unexpended Uncommitted Balance.

  • THE QUESTION WAS CALLED ON THE MAIN MOTION, AS AMENDED, AND DECLARED CARRIED, with Mayor Cumming and Councillor Guy opposed.  The Motion reads as follows:

     

    THAT Council receive for information the memorandum titled "Marshall Field - Proposed Fencing" dated May 10, 2023, and respectfully submitted by the Manager, Parks and Public Spaces;

    AND FURTHER, that Council authorize Administration to install a fence at Marshall Field as identified in Attachment A: Original Fence Option in the memorandum titled "Marshall Field - Proposed Fencing" with the following exception:

    THAT Council receive for information the memorandum titled "Goose Management Update" dated June 6, 2023 and respectfully submitted by the Manager, Parks and Public Spaces;

    AND FURTHER, that Council directs Administration to abandon the "Kill to Scare" program for potential goose management as Administration has been unsuccessful in obtaining interested contractors and the Request for Expression of Interest was not successful;

    AND FURTHER, that Council directs Administration to bring back other options for the goose management.

    THAT Council receive for information the memorandum titled "O'Keefe Ranch Asset Management/Heritage Conservation Plan" dated May 10, 2023 and respectfully submitted by the Manager, Infrastructure Systems;

    AND FURTHER, that Council authorize the expenditure of up to $70,000 for the Conservation Plan and Asset Management Plan of the O'Keefe Ranch, to be funded by the 2022 Unexpended Uncommitted Balance; 

    AND FURTHER, that Council direct Administration to separate the Conservation and Asset Management Plans into three phases, with an option to not proceed based on the findings in each phase.

    THAT Council receive for information the memorandum titled "Riparian Areas Protection Regulation (RAPR) Assessment Report and Development Variance Permit Applications" dated June 1, 2023 and respectfully submitted by the Approving Officer;

    AND FURTHER, that Council acknowledges that an amendment to the City of Vernon Development Application Form will not require an approved RAPR Assessment Report prior to any conditional approval.

    THAT Council receive for information the memorandum titled "Response to BC Homes for People Action Plan" dated June 5, 2023 and respectfully submitted by the Long Range Planner and Acting General Manager, Planning;

    AND FURTHER, as recommended by the Affordable Housing Action Committee, that Council write a letter from the Mayor to the Minister of Housing in relation to the BC Homes for People Action Plan.

    THAT Council ratifies and confirms the following resolutions adopted at the June 12, 2023 Committee of the Whole meeting of Council:

    Secondary Suite Inclusion in Semi-Detached Dwellings (6441-20)

    THAT Council direct Administration to draft amendments to Zoning Bylaw 5000 to allow secondary suites in all residential zones, including RTR, RTC, and RTCA zones, as a permitted use in both single detached and semi-detached dwellings as outlined in the report titled "Secondary Suite Inclusion in Semi-Detached Dwellings" dated June 1, 2023 and respectfully submitted by the Long Range Planner.

    2023 UBCM Convention Meeting with Ministers Request (0360-20-27)

    THAT Council authorizes the Mayor to send a letter to the Minister of Housing, Ravi Kahlon and Premier, David Eby to advocate for a review of the Shelter Aid For Elderly Renters (SAFER) program. The review is to include how rent caps impact SAFER subsidies, the 30% of gross limit and how to avoid income assistance and pension increases from decreasing SAFER subsidies;

    AND FURTHER, that Council submit a motion for consideration at UBCM which takes place in September of 2023.

    2023 UBCM Convention Meeting with Ministers Request (0360-20-27)

    THAT Council direct Administration to request meetings with the following Cabinet Ministers during the 2023 UBCM Convention, to discuss the following: 

    1. Solicitor General – Vernon Court House
    2. Minister of Environment and Climate Change Strategy – update on the progress with reducing fuel load and associated wildfire potential in the Aberdeen Plateau
    3. Minister of Forests – update on the progress with reducing fuel load and associated wildfire potential in the Aberdeen Plateau 
    4. Minister of Water, Land & Resource Stewardship - update on the progress with reducing fuel load and associated wildfire potential in the Aberdeen Plateau
    5. Minister of Municipal Affairs  - reinforce desire to have the province be a financial partner on the Active Living Centre
    6. Minister of Tourism, Arts, Culture and Sport - reinforce desire to have the province be a financial partner on the Active Living Centre
    7. Minister of Social Development and Poverty Reduction and the Minister of Housing – to advocate for a review of the Shelter Aid for Elderly Renters (SAFER) Program
    8. Minister responsible for funding mental health and addiction services – to increase funding for mental health and addiction services;

    AND FURTHER, that Council supports potential joint meetings with the Regional District of the North Okanagan regarding food security and the Aberdeen Plateau.

Vernon RCMP Detachment Electronic Door Access Upgrade (7400-30)

THAT Council approve the purchase and installation of an upgraded and expanded electronic door access system at the cost of approximately $35,000, with the source of funds to be the 2022 prior year unexpended uncommitted funds, as described in the memorandum titled "Vernon RCMP Detachment Electronic Door Access System Upgrade" dated May 30, 2023 and respectfully submitted by the General Manager, Municipal Support Services RCMP;

AND FURTHER, that the resolution be declassified. 

Tourism Commission Membership (0540-20)

THAT Council appoints Kristina Fuller to the Tourism Commission as the representative for the Sports and Events Sector for a period expiring in May 2025;

AND FURTHER, that Council appoints Gerran Thorhaug to the Tourism Commission as the representative for the Restaurant Sector for a period expiring in May 2025;

AND FURTHER, that Council declassify and remove from In Camera the appointed members to the Tourism Commission once all applicants have been notified.

Economic Development Advisory Committee Membership (0540-20)

THAT Council appoint Mr. Larry Olson to the Economic Development Advisory Committee as the representative for the Province of BC – Regional Economic Operations Branch until January 2025, as described in the memorandum titled “Economic Development Advisory Committee Membership” dated May 9, 2023 and respectfully submitted by the Committee Clerk;

AND FURTHER, that Council declassify and remove from In Camera the appointed member to the Economic Development Advisory Committee once Mr. Olson has been notified of the appointment.

    THAT Council approve the 2022 Annual Report for the City of Vernon as attached to the memorandum titled "2022 Annual Report" dated June 1, 2023 and respectfully submitted by the Manager, Financial Planning & Reporting;

    AND FURTHER, that Council direct Administration to schedule a Public Meeting to receive submissions and questions from the public concerning the 2022 Annual Report on Monday, June 26, 2023.

    1. THAT Council approve a Council Discretionary Grant to Archway Society for Domestic Peace in the amount of $6,000 out of the requested amount of $12,000 to help coordinate the various government and community services that respond to child abuse in our community.
    2. THAT Council deny a Council Discretionary Grant to Arts Council of the North Okanagan in the amount of $15,000 as the City has limited funds for disbursement.
    3. THAT Council deny a Council Discretionary Grant to BrainTrust Canada in the amount of $15,000 as the City has limited funds for disbursement.
    4. THAT Council deny a Council Discretionary Grant to Canadian Mental Health Association in the amount of $15,000 as the City has limited funds for disbursement.
    5. THAT Council deny a Council Discretionary Grant to Compassionate Friends Vernon in the amount of $5,000 as the City has limited funds for disbursement.
    6. THAT Council approve a Council Discretionary Grant to Family Resource Centre Society for the North Okanagan in the amount of $4,200 to provide immediate short-term counselling for men who have experienced sexual assault. 
    7. THAT Council deny a Council Discretionary Grant to Forever Home Sanctuary Society in the amount of $16,500 due to incomplete submitted financial statements.
    8. THAT Council deny a Council Discretionary Grant to Fresh Outlook Foundation in the amount of $20,000 due to incomplete financial statements.
    9. THAT Council deny a Council Discretionary Grant to Helping Out People Exploited (Hope Outreach) in the amount of $5,000 as the City has limited funds for disbursement.
    10. THAT Council approve a Council Discretionary Grant to John Rudy Health Resource Centre Association in the amount of $6,670 out of the requested amount of $11,670 to assist in the cost of transportation to medical appointments.
    11. THAT Council deny a Council Discretionary Grant to Kalamalka Bowl Society in the amount of $5,000 as the City has limited funds for disbursement.
    12. THAT Council approve a Council Discretionary Grant to Kalamalka Fly Fishers Society in the amount of $8,000 to purchase equipment and tools needed to maintain the Polson Park pond kids free fishing weekend program.
    13. THAT Council approve a Council Discretionary Grant to Maven Lane Childcare Centre in the amount of $10,000 to install a perimeter fence at Maven Lane.
    14. THAT Council deny a Council Discretionary Grant to North Okanagan Cycling Society in the amount of $5,000 as the City has limited funds for disbursement.
    15. THAT Council deny a Council Discretionary Grant to North Okanagan Hospice Society in the amount of $25,000 as the City has limited funds for disbursement. 
    16. THAT Council deny a Council Discretionary Grant to North Okanagan Pipes & Drums in the amount of $5,000 due to incomplete submitted financial statements.
    17. THAT Council deny a Council Discretionary Grant to North Okanagan Taekwondo Association in the amount of $3,000 as the request is for retroactive funding.
    18. THAT Council deny a Council Discretionary Grant to North Okanagan Youth and Family Services Society in the amount of $10,000 as the City has limited funds for disbursement.
    19. THAT Council deny a Council Discretionary Grant to Okanagan Indian Band – Komasket Powwow in the amount of $5,000 as the City has limited funds for disbursement.
    20. THAT Council deny a Council Discretionary Grant to Okanagan Landing Community Association in the amount of $24,900 as the City has limited funds for disbursement;
      AND FURTHER that Council request Administration to work with the Okanagan Landing Committee to determine appropriate responsibility for the maintenance of trees in Paddlewheel Park, and if necessary, bring forward possible alternate funding sources.
    21. THAT Council deny a Council Discretionary Grant to Okanagan Screen Arts Society in the amount of $5,000 as the City has limited funds for disbursement.
    22. THAT Council deny a Council Discretionary Grant to Okanagan Village Housing Society in the amount of $10,000 as the City has limited funds for disbursement.
    23. THAT Council deny a Council Discretionary Grant to People Place Society in the amount of $30,000 as the City has limited funds for disbursement.
    24. THAT Council approve a Council Discretionary Grant to Powerhouse Theatrical Society in the amount of $2,500 to offset production costs for performances where ticket fees are not charged.
    25. THAT Council deny a Council Discretionary Grant to Predator Ridge Community Safety Committee in the amount of $2,000 as the City has limited funds for disbursement.
    26. THAT Council deny a Council Discretionary Grant to Sadok Ukrainian Dance Ensemble Society of Vernon in the amount of $3,000 as the City has limited funds for disbursement.
    27. THAT Council deny a Council Discretionary Grant to the School District 22 (Outdoor Education Program) in the amount of $5,000 as the City has limited funds for disbursement.
    28. THAT Council deny a Council Discretionary Grant to Sleep in Heavenly Peace (SHP) Vernon in the amount of $20,000 as the City has limited funds for disbursement.
    29. THAT Council deny a Council Discretionary Grant to Sovereign Lake Nordic Club (SLNC) in the amount of $4,368 as the City has limited funds for disbursement.
    30. THAT Council approve a Council Discretionary Grant to Upper Room Mission Society in the amount of $6,500 to purchase two new commercial grade laundry washing and drying machines.
    31. THAT Council deny a Council Discretionary Grant to Vernon Amateur Athletics Association in the amount of $5,000 as the City has limited funds for disbursement.
    32. THAT Council deny a Council Discretionary Grant to Vernon BMX in the amount of $5,000 as the City has limited funds for disbursement. 
    33. THAT Council deny a Council Discretionary Grant to Vernon Community Band Society in the amount of $800 as the City has limited funds for disbursement. 
    34. THAT Council deny a Council Discretionary Grant to Vernon Community Music School in the amount of $2,010 as the City has limited funds for disbursement;
      AND FURTHER that Council direct Administration to request that the Vernon Community Music School apply to the Heritage Restoration Grant Program for repairs of the Carriage House building.
    35. THAT Council deny a Council Discretionary Grant to Vernon & District Association for Community Living in the amount of $15,000 as the City has limited funds for disbursement.
    36. THAT Council deny a Council Discretionary Grant to Vernon and District Family History Society in the amount of $5,000 as the City has limited funds for disbursement.
    37. THAT Council deny a Council Discretionary Grant to Vernon Jazz Society in the amount of $5,000 as the City has limited funds for disbursement.
    38. THAT Council deny a Council Discretionary Grant to Vernon Lawn Bowling Club in the amount of $7,500 as the City has limited funds for disbursement;
      AND FURTHER that Council request Administration to work with Vernon Lawn Bowling Club to determine appropriate responsibility for the entrance to the grounds in Polson Park, and if necessary, bring forward possible alternate funding sources.
    39. THAT Council deny a Council Discretionary Grant to Vernon Paddling Centre Society in the amount of $7,000 as the City has limited funds for disbursement.
    40. THAT Council deny a Council Discretionary Grant to Vernon Restholm Association in the amount of $10,000 as the City has limited funds for disbursement.
    41. THAT Council deny a Council Discretionary Grant to Vernon Ribfest Society in the amount of $10,000 as the City has limited funds for disbursement.
    42. THAT Council deny a Council Discretionary Grant to Vernon Veterans Society in the amount of $20,000 as the City has limited funds for disbursement.
    43. THAT Council deny a Council Discretionary Grant to Vernon Winter Carnival Society in the amount of $15,000 as the City has limited funds for disbursement.
    44. THAT Council increase the 2023 Council Discretionary Grant program by an additional $50,000, to be funded from the 2022 unexpended uncommitted reserve;
      AND FURTHER that Council approve a Council Discretionary Grant to People Place Society in the amount of $30,000 to purchase and build a front entrance gate and fence. As per Council Discretionary Grant Policy, audited financial statements have been provided.  
    45. THAT Council, as recommended by the Finance Committee, include additional funding for the Council Discretionary Grant program for the 2024 budget and onwards, increasing the Council Discretionary Grant program to $100,000.
